contacted a lawyer about my stryker knee

Since I am still in pain and not that mobile I contacted a lawyer in Philadelphia about my stryker tkr and he thinks   I have a case against stryker.  So he is sending me paperwork for me to have him represent me against stryker.  He asked me all kinds of questions  and I answered them truthly. 

There are so many ppl out there that had stryker knee relacements that are in pain and nonfunctioning movement.

I will keep you up to date as I get the paperwork.

Hi Betsey, with a class action lawsuit already on the table against this company, I think it could require some extra "hoop jumping", and red tape, before you actually see a positive outcome from filing, just curious if you know if your lawyer plans on attaching to the open suit, or filing your own case, I really have little knowledge of suits like this, so I'm anxious to find out what you will be doing, and how your attorney plans on attacking this. I'm sure you'll probably find out by reading the stack of papers that your attorney sends you.

I know that their hip replacement Rejuvenate and ABG II modular neck-stem are the two that have been recalled in July of this year...But I thought they were only used for the hip surgery and not for the knees?


If you are not a recipient of either of these specific models, I think it's going to be very difficult to have a case against them since nothing else has been recalled..

I received the standard letter of rejection unable to take my case and encouraging me to find another lawyer.

So I emailed another law firm this one in Harrisburg, only takes money if you win money. So I will see he takes my case.

Hi Betsy, just wanted to wish you luck on this journey, also, make sure that the ortho surgeon that you have examin you is a QME (qualified medical examiner), a QME's opinion holds a lot more weight in court than a regular doctor.

Hi Betsy, after reading your post, I looked it up, it's 'qualified medical evaluator' and apparently it's another medical cert, but only applicable here in California. Sorry for the misinformation.

Is the 2nd atty taking your case, if so, rather than rely on a practicing dr to point a finger at another dr and say they did something wrong, which rarely happens, an independant medical expert can review your medical records and determine if malpractice occurred. The lawyer should know where to find a expert for your case, but it can cost around $4,000 up front to review your medical records. These experts do this for a living and they don't care who's toes they step on where a practicing dr rarely will testify against a peer. Granted the experts are very expensive and their fees are paid in advance before they do anything.

In my state which is Texas you must have an experts written opinion when you file a lawsuit, the written report has to be filed with the court within 60 days or case gets tossed out by the judge.

See, part of the Hippocratic Oath, and it's various other forms, including the Declaration of Geneva, etc (Check Wikipedia on the variations that they use), that some docs take very seriously, is that they won't testify against another doctor. They will give a second opinion, but unless the original doc has had their license pulled for being a moron, that other doctor is treated (as the Geneva one says) as a sister or brother.

Finding one doctor to testify against another is hard. Finding 25 doctors to testify FOR another doctor is as easy as opening the phone book. It's a closed society.

Just a heads up on what you will be facing.

In my case, my doc and attorney both agreed that I should turn the bad doctor in to the medical board. My attorney said the findings from the medical board hearing, which is.scheduled for January, will be the best evidence in civil court. It's a gamble though in my state, because of the statutes of limitations on filing a law suit, you have one year to do it, and if the medical board hadn't scheduled the hearing as early as they did, I would have had to do the independent evaluation thing. But they took my sworn statement, and did an investigation, and.concluded that a hearing needes to take place, so that doctor's license has been suspended until after the hearing.
