Betsey the max in medical mal is 33.3% no matter whether your in a state with a cap or not. Thtnis the total combined Attys can collect.
If the origional Atty reffered you o another atty and is charging 3% then the atty that actually handles the law suit and ant recovery monies is the one responsible for paying the referring atty.
It matters not how many actual attys end up doing anything and their fees for doing that something as it is always paid out of the origional 33.3%.
I suppose this is their reasoning behind charging the entire amount they can since they ever know in these cases how many atty fees they will be paying out. It is such a long drawn out usually years process and they often use several consulting attys as well as the paralegals to do all the research and leg work,filing documents and such and all charging their own 2-3%.
Therefore if an atty and certainly 2 agree to take the case on then you can be assured they think they can win it since generally the aatorney on record for the suit pays many many ppl out of pocket to do lots of the work long before any recovery so if he loses he loses in a big way as to any costs he has incurred.
