my disability answer

I am almost afraid to type this out....I still keep thinking I must have heard wrong....but the judge granted my disability today as soon as the testimony was done. I was stunned, and I said "thank you, your honor"........but then when I got in the hallway - my lawyer said "do you understand what just happened?" I said "I think so." He then said "you won." I almost burst into tears, but was able to contain myself. My lawyer said that this judge usually does not give out his decision right away like that - so there was no doubt in the judge's mind about my disability.

He verbally stated I was disabled due to depression, fatigue and cognition. All I did was tell the truth, just like my lawyer told me to do. I had some trouble finding the proper words at times, and the judge even tried to help me once by guessing what I was trying to say, but I had to tell him no, that wasn't it. He just smiled.

I am thanking God today, as my 3yr old ordeal to get disability for my depression and fibro is finally over. Thank you all for your support. I'll try to answer any questions you may have....but man am I exhausted after all that.

I'm sure that takes a lot of stress off of you. I was just looking at short term disability today from Aflec and the lady said if you have been diagnosed with any of these diseases within the last 5 years you are disqualified.I was surprised to see that Fibromyalgia and chronic fatigue syndrome were both on the list.I was very disappointed,but I guess this does show that this is being recognized as a true and legitimate disease. It made me nervous because I work ft,and if I needed to take awhile off,how would I pay my mortgage etc.It's really scary when you have something like this that can prevent youfrom working the rest of your life.I was trying to think ahead.

Oh my goodness...I am so happy for you! Been there and done that! That IS the longest 3 years of your life waiting for an answer. Mine was 6 years ago and I was so glad to get it over with. I still don't understand WHY it take so long...but you made it! Now be careful and plan your life to be as happy as you can be! Blessings to you!

Thank you all for your kind words. Being disabled is not an easy thing. Getting benefits helps it be something one can bear.

I am so happy that you received your disability.  I saw that you had to wait 3 years to get it.  How many times were you turned down after your first application?  My appeal will take place over the summer.  I hope I get a judge that is understanding as yours was.  What questions did he ask?  I am sooooo happy for you.  Hope to hear from you.

I am so very happy for you! I began applying for disability in 2003, and am still not on it. It's good to hear of someone else succeeding, in spite of the system being stacked against us!

I just remembered a few questions -

What housework can I do? Why did I quit my last job? How is my driving? How far can I walk? How does stress affect me? Do I nap during the day? How do I sleep at night?

I'll try to think of more.

That is great news!!!My daughter won her claim today too. Saw the judge this morning and won her case today. He based his decision on her severe depression and not the fm/cfs. It took her almost 2 years. Was afraid she wouldn't get it cause of her age...she is 25, but she got it.

Congratulations on finally winning your claim! I was diagnosed last December, and I was looking into applying for SSI, due to the fact that I haven't worked enough in the past 10 years to apply for SSD.

What is my first step? It all seems to be so confusing. Should I get a lawyer right off the bat, or apply and wait for the denial first?(because it's always denied the first time) Should I go to all the places I was treated for Fibro, depression and migraines and try to get all the records?
