YEP I hear ya there
They have a ZERO tolerance here about this believe me and asket would be in the bucket
I was once thrown in drunk tank at 16 yrs old.........
NO fun
But I never ran into a car causing so MUCH bodily harm to someone
I was just walking home.................... well staggering lol

I agree with you guys and cant get my head round how this man was allowed to just walk out the hospital with no further enquires or without being charged. I really do hope the police are planning on following this up as someone needs to be held responsible for this and in my book a man who gets behind the wheel of a car drunk and then crashes into someone causing serious injury needs to be put behind bars. My thoughts are still with Nikki and her family and I hope her condition continues to improve, Garen keep us posted and how are you doing?

Garen, I am looking forward to your update. Question.... Is she on a ventilator (breathing machine?) Has she started to wake up/open her eyes, or do they still have her in a drug-induced coma? Blessings, Julie

Well it is almost 4 PM in the EDT and I am wondering how Nikki is too.

As for the drunken driver, having worked in and managed an ER for many years I had a close relationship with local, county and state police, and no, this person would not have walked out of the hospital.  He would have  been charged with driving under the influence and  vehicular bodily injury at the least.  To jail and from there in front of a judge for charges.  We have the county jail and courthouse right here in our town. I am a firm supporter of MADD.

Also I know she is in a trauma center and was surprised to hear the physician were worried that she might have the flu because her lungs sound gunky when she has broken ribs, a chest tube and just underwent hours of surgery.  I would also expect a temp at this stage although I am sure she is on tons of antibiotics.  Also her eye is most likely bandaged if it has severe damage.  She must have had a huge tem working on her.

I am glad we have the pictures of her from the park as I am sure she is one huge bruise, dear little nikki.  Life is so unfair. 

I have a prayer group going for her and for her family and for you too Garen. 

Please know we are all right here and keeping a vigil around the world for nikki.

I guess the shock has worn off and now members are angry that someone caused the crash by driving drunk and nikki was the victim here.

Glad to hear your eating today. Take care of yourself. Listen to Scott, he looks at you like a younger brother & really has your best interests in mind.

I was praying for Nikki all night & will continue praying for her now. I am happy to hear that the docs at least found out what was causing the problems with her & are keeping close watch over her. I do pray that she is able to beat the flu very quickly & get back to healing her other injuries. Hugs to you & the family. :)

I think we really need to stay focused on Nikki, but I used to work with the lobby against drunk driving in my state. It is different in every state, so I'm not sure what all the rules are where Nikki lives. The driver would have gotten several tickets for misdemeanor offenses at the time of the collision. He would have had his license suspended immediately for 30 days, pending trial. Beyond that, there are different levels of felonies with which he could be charged. Sometimes the DA wants to see the extent of injuries before deciding which class of felony to charge the driver with. They don't have to do that in all cases, at least in some states, but it is not uncommon to wait and see what happens. At a minimum, he will be facing serious fines & jail time. On top of that, Nikki & her family have the option to try and sue for civil damages, though usually that would start after the criminal case concludes.
Hopefully that answers some of your questions. I understand how easy it is to get angry at that driver. Honestly, I personally believe that no one should be allowed to drive if they've had even one drink & I'm sure this guy had many more. But Garen & Nikki's family need to focus on caring for her right now, not trying to chase down what's going on with that driver. There will come a time for all that, but right now Nikki needs all the positive energy we can send her way.

Wow.  I'm away for a day and so much happens.  I am sad Nikki spiked a fever but hope it is down by now.  I had to go back and read the other thread (every single post I read) and now am caught up.  Garen, I cannot say how grateful I am that you are with Nikki and that you are keeping us up-to-date.  What a special friend you are to Nikki and what a wonderful person you are for keeping us updated.  I will e-mail Kitt right now to get Nikki's address.

I'm so glad to hear that Nikki is doing a bit better.  Garen, I know you're probably sick of hearing it, but take care of you too.  I'll be sending out more prayers for both of you!

If anyone is interested: If you visit the site for the hospital that Nikki is in, you can send her a cheer card right from the site.  Thought it would be easier since there is some confusion about where to send cards right now.

I was thinking, one day in the future, Nikki will read all the threads and know just how much she is loved. That will be such an exciting day!

I agree that every hour means she's that much better, and each day too!

Maybe the smile is because she IS having good dreams!
