I googled pet food recall lawsuit and found a law firm in Canada that is starting the class action suit. I have already signed up for it. Luckily my vet bill is only around $300, but my cat was not as bad off as some. I am also very lucky to have two friends who are helping me pay it. I would like to sue for the pain and suffering endured by both my cat and me but I doubt I would get far with that. I know a lot of people view pets as property, not companions.
I'm not sure I would've signed up to join the class just yet.
I would try dealing with the company directly first and see where that takes me. Write a letter and include a vet invoice along with some proof that I had their food. Offer to settle the case for 850 USD. Tell them they have three weeks to respond. Send the letter certified to the President or CEO of the company.
It won't hurt. Class action suits move slowly and there's plenty of time to jump in later.
The problem is, if Menu goes bankrupt because of this, nobody's going to see any of that judgment money. Even if they settle the case and then go bankrupt, not all plaintiffs will receive their award (attorneys take their fees and expenses first). That's why I'd give it a shot now while they're still solvent.
It's a longshot, yeah, but worth a try.
