I finally had my hearing on Monday for my disability claim I filled for 2 years ago. I went into this hearing really feeling like I didn't have a chance of being approved. As I sat and waited for my turn I overheard tons of other folks with their lawyers telling them all pretty much the same thing that it would be 30 to 90 days after this hearing to receive a determination on their case. The thought of having to wait another 3 months to find out the outcome was depressing. Once I was called in to see the judge the process only took about 15 min. At the end of the questions the judge asked my lawyer something to do with a 2 month period from my last day of work in 09 and 10 then the judge told the clerk to stop recording and go off record so that my lawyer could ask me if I would four fit 2 months of pass pay and that what she was saying is that if I was willing to do this I was approved right on the spot. Well I don't think I have to say what my decision was. I just wanted to post this so that anyone waiting or thinking about filing for disability can maybe get a little bit of hope for themselves. I give God all the credit. Good luck to all.

Patsy wonderful news for you indeed. I am so glad things went well at your hearing. And you are so right, those 4 months were easy to give up.

Shell most LTD companys require a person to file for SSD. Are you currently off on LTD? If you are approved for SSD while receiving LTD, SSD gets an offset from the LTD. Meaning you cannot receive full monthly benefits at the same time from both companies. I believe they work it so between the two you receive what you actually made while employed. Once you turn 65 as with most LTD companys you switch over to regular SS. Do you have any specific questions? Your LTD company may have someone to help with filing for the SSD too. My neighbor was a nurse and she was off on LTD and SSD. When I worked as a paralegal we had some clients as well that was in the process of filing for both.

The way most Longterm disability policies work is that, whatever you are being paid by the LTD they being to subtract what you get from SSD, so that you onlly get what you are already receiving. They usually require u to apply for SSD, because of this. HOWEVER, since the LTD pays till 65 in most cases, and by taking SSD early you lose 25% of your benefit u would have received if you waited till 65, you actually lose out in the long run.

THis happened to me. I had a LTD policy through the hospital where I worked, After, several years, they required me to file for SS D which I had not planned to do until 65, then they subtracted from my monthly benefit, the amount SS pays, which if you have kids, is your part and the part they pay for your kids. Therefore the LTD company is the only one who profits. just a little FYI.
