Set apt to talk to Dr....

So I set an apt for the 12th to talk to my Dr about applying for disability. I am really nervous. I dont want him to think I am crazy or not want to go along with it.... I have been with him for almost 20 years... But I am only 35.... I have serious, well documented condition(s), just nervous!!
(well, I think they are bad....?)
What should I say? What should I ask? Please help me with this, maybe it will calm my nerves....(this apt I will talk about this new horrible hip pain)

Also, I called a lawyer, he said to apply and if I get denied to appeal then if I get denied again, to get an attorney.... Is that right?
When should I actually obtain one?

One more thing, I am also in process of writing it out in black and white for my husband (the warden) to see that even a $13hr job would Not pay a lot more than SSD once you subtract medical, taxes, etc.... He thinks I need to just go to work somehow cuz we need the paycheck...

I am currently collecting UE, do I need to stop claiming? I think I do, but don't know what to do without that income... Plus the warden would get SOOOO mad..

Quick question (if you don't mind). Is your husband an actual warden or is that just a term of endearment? I don't mean to pry, but I have some direct knowledge there.

On another note, I woudl highly recommend that you hire the attorney after the appeal. My best friend got hers on the first try...mine took an attorney, but you never know.

It is very important that you have all of your documentation ready and organized. You can send it in online and that helped me a great deal because my hands don't work really well. Be prepared to say the same things over and over!

You can not work and claim to be disabled, so you may want to make the permanent decision with your husband before you file. It could take quite a while and you will need his support (both financial and emotional). I know I did!

You also mention Psych problems (depression) and I think it is ESSENTIAl that you use this information when you file. Psych problems are different than physical ones. You will likely be referred for an evaluation by SSD Dr's. This is not unusual and not something to be scared of. It DID make a difference for me. I did not have to have a physical eval, but my friend did.

I wish you all of the best and hope things will work out well for you! My problems now are worse than when I filed and I make CERTAIN to follow up with all Dr apts to keep records up to date just in case they evaluate the case later. Again, keep all paperwork and documention.

Calling my husband the warden is a term of UNendearment....
I have a lot of depression associated with him and how I am treated... I posed about that in a different post... Not good.

I am currently writing it out for him to see I cannot work. I even printed out some info about my conditions etc, hoping if he reads it he can better understand... Even though he already should!!! He is so stubborn and only cares about himself and what people think of him (us)....

I am getting things organized to file... Just hoping I can be one of those very few that get accepted fast without complications, but doubt it.

I have just completed my disability application and the additional questionnaire. Now to take in the paperwork documents I have. Some dr records date back to when I was 4!!!! Hope I get it.

I agree with the other comments. You need to be sure to address all of your conditions, because they are supposed to factor in the combination of all your conditions--and how they limit you together, not just one at a time.

There is a form that lawyers often give out called a Residual Functional Capacity Form. It'd maybe be helpful to take it in to a doctor appointment some time, maybe you could talk to him about filling one out on another visit.

Also, if you can't work--you can't work! I know it's hard to take the potential income loss, but if you can't do this then it isn't really a choice for you. So if you're to the point now that you can't work, it isnt like you can just 'suck it up' or whatever. So I'd try an emphasize that to your husband--that it isn't like you have much of a choice in the matter, you can't work if you want to!

Donna is this permanent disability? Is this through your government or your job? I have had to go off on disability however, mine is through my job so if I have a flare up with my fibro I go off on dip when I am better I just go back to work. Now if I had to go off permantly then I would have to apply through our government. Can you collect UI until you get your disability so you won't miss a paycheck? I hope that your husband is better understands it when he sees it on paper. Maybe he could come with you to the doctors on the 12th and this might help him if he hears it straight from the doc.

Donna...

I've followed your story on here.... and there are so many well versed to help you w/ all this type of stuff. I know they will be along when they see your post I wish there was more that I could say to help; I just don't really know all the ins/outs legality-wise.

BUT, I can offer you a hug and let you know I'm thinking of you.... and pray that the doors that are opening will be ones to a better life for you....

Donna, I'm sorry to say but I don't think you can collect unemployment while filing for SSDI. By receiving unemployment you are saying you are actively seeking employment and able to work.

Definately get a lawyer after your first denial. Make sure they only get paid if you win. SS will set the amount they can receive from your back pay which is usually 25% up to $6000. It took me 2 years to get my SSDI and the lawyer got $6000, sucks doesn't it.

Social Security will ask you to sign release forms so they can request medical records from all the doctors you put on your application so don't miss any. Especially you want records from specialists. SS doesn't put much creedance in what a family physician has to say.

Misterkat mentioned an RFC form. You definately want this form filed out by all of your doctors. This is the #1 form that SS will look at and it was the RFC form from my pain management doctor that finally won my case for me.

Donna, Jag is correct about getting UE and filing for SSD. When you get UE you are stating that you are physically capable of working at a job, can't be both ways.

Get busy now looking for an atty that handles nothing but SSD claims and be sure to hire someone local in your area. Stay away from the jerks on tv that toot their own horn, they are usually not worth shooting, don't get caught up in their trap. By looking now if you need one then you will already have one in mind.

Attys like to get involved after you have been turned down the first time.
