You bring up some good legal points. Here in SC, the only limit is for "pain and suffering", which is capped at $300,000. I am on my 4th lawyer, and my statute of limitations (which was 3 years) is quickly running out. If my current attorney bails on me, I won't have time to secure another. The other attorney's were what are known as "cherry pickers", and after wasting months on my case, simply walked away from it.
They already have the testimony of both my uro/surgeon and my oncologist. They need to secure some opinions from some neutral radiation oncologists.
I was left 100% perm. disabled from the damages, which should have never happened. Even Social Security agreed with the findings, and you know how hard they are to convince of anything. On paper, my case looks good, but again, the laws favor the doctor. Interestingly, the guilty party in my case had already lost two malpractice cases against her, so you think that would work in my favor.
