Hired a lawyer for SSDI appeal!!

I got myself a lawyer yesterday for my SSDI appeal, now I have to wait again.  He said that it will be around 3 months before you hear of a decision on the appeal and that only about 10% of people filing will get approved at the reconsideration part.  He had me go ahead and sign paperwork ahead of time to move onto the ALJ phase in case I am one of the 90% that get denied on the appeal.

He did say that with my medical condition that I definately do show reason for being disabled.  The law firm I hired only gets paid if I win and will be paid from any back pay I have coming to me.  The amount allowed by SS is 25% up to $6,000.

I'll let you all know when I hear something.

Cool, good news indeed. No one should ever pay a lawyer up front for SSD, and any atty fees should come out of the past due benefits. When you are awarded benefits he must file a Fee Petition with SS and give a detailed report of all work done on your file. SS has guidlelines on what they can charge for their work too, they leave little room for an atty to try and pad the bill. This is the way it is suppose to be done. Good luck.

I'll be following your progress! How did you find the lawyer - just curious. Susie has mentioned finding ones that are Board Certified with SSD. I wondered if this is how you located one.

This can be a time consuming process, but now you have a Lawyer, it really is rather easy, they can do everything. So all you have to do hang in there, and be frustrated at some of the sillyness of it all and just wait it out, I am sure you will end up getting it approved. It is just a matter of going through the process!

My town isn't hugh but I knew I wanted someone fairly close that I could make eye contact with. I checked in our phone book and found this group. They were the only ones that handled SSDI cases. Their main office is in a larger city but they have a sattelite office here just like a lot of doctors do.

By chance I was talking to a very nice college age boy that works at the local grocery store one day and it just so happened that his mother used this law firm to win her SSDI case when she was denied and she ended up winning her case (she also has back issues, we didn't go into details though). It seemed like karma that I happened to talk to him and this came up in our conversation.

I really didn't have alot of options unless I wanted to drive a great distance or use one of the law firms that advertise on tv.

Good Luck to you. I have been trying for disability for 2 years now. In december I just went to one of their doctors and I am still waiting to hear from them. I still havent got a denial letter so I cant get a lawyer yet.
