no court, for me, she will never drive again, I'm sure. As it was she was driving on suspended license, and a borrowed car, my truck will be payed off, then whats left I buy new one. But no, I will not have to go to court, purely settlement. But very depressed, and my orders are coming in fast, so it will be a tough summer, painful summer.

Oh my, I hope your neck/back heal up quickly. Goodness!! People who aren't licensed drivers should at least drive more carefully.

not only that, I forgot so much stuff in my truck, for instance, I have my expensive pruners and loppers, they cost $120, $25 googles I use for eye protection when I'm, cutting my willows or cedars, my crdit card machine, I had 2 mosquito hats, really good x-tra tall rubber boots I use in the bush, when getting raw material. I went to retrieve my small suitcase when I got out of er, but i was on morphine, they gave me 1 shot for back pain, thenI started cramping and rang for nurse, told I had cd and was cramping, I have never had a response for pain med's that fast, they gave me another shot, then after determining nothing was broke they kicked me out, called me a cab and I went to where truck was and took this little suitcase that had my med's and pj's. how stupid is that to not get other stuff, now I've called salvage yard, and they said we can't ship or take stuff out, your adjuster should have done that, I've called left messages, they don't care. but my pruners and loppers are made in sweden, they're the best you can buy. I want justice that the woman that drove that car, can never be allowed to get behind a wheel, she was in fast lane at 75 miles per hour and tryed to haul butt over three lanes to make it over to other freeway, in the rain on slick roads, and I just happened to be in her way innocently parked in er parking. as bad as a drunk driver

The person who suggested a PI lawyer was right on. What will happen is your insurance company will settle with you (minus your deductible) then go after the person that hit you in a subrogation claim. All that means is that you will be the named plaintiff and will have to testify should it go to trial, you won't share in the cost.

That being said, with this defendant your insurance company won't want to pay you much, and certainly won't pay you a dime over her ceiling if it's lower than yours as the recovery potential is small.

If you settle with your insurance company, you'll certainly get money faster...which is what they're counting on. I'm not knocking the insurance company here, it's just how it works. I love mine and have always been treated fairly, but I would expect nothing less of them.

I should also mention, that in some states if you can prove the owner knew the driver was uninsured or on an expired license, you can go after them as well.

o dawg, I think greedy is good in a situation like this, it gets kind of complicated, in soft tissue only it's medical costs then times 2 or 3, so believe it or not in california, typically 3xweek for 12 weeks is all jury feels you need for physical therapy, but now their is cd that has been effected, then what jusry sometimes say if it goes that far is. well he had cd first so maybe it would have flared anyway, but I painted myself into corner with mex. ins. because very hard to have american lawyer deal with mex. dr my lawyer is going to try and work with pain clinic here in san diego, work on contingment basis, just getting oxycodone without ins. is really expensive. my lawyer's secretary speaks fluent spanish, so that will help, she can at least help me make appt. usually there secretaries don't speak english, so making appt. is hard, but it is start, I'm basically sueing my own ins. co. on my own policy, to get at least $100,00. thais what my policy is for underinsured drivers on there policy, this guys policy is $15,000 for 1 person, mine is $100,000 for 1 $300.000 for 2 people. so no my lawyer explained his job last nite is to minimize my output and realize as much as he can get me. don't forget there are over 30 million people here in ca. so they are tough on soft tissue cases, it's just going to take time and I'm going to have to spend some money to get more in the end. for instancew if I spend 6 grand on physical therapy, they will award me another 12-18 grand, then my lawyer has to get letter from gi to address cd flare because of accident. fine line. ins. co's are a piece of work.

yea I know sniper, you are right, but now this piece of crap disease is now decided to flare in throat and cankers, again, tongue is no good as well, please nobody tell me to rinse with that temporary stuff, it doesn't work for me, it has to heal from inside, so my gi has to try to come up with something other than biologics, I can't take them, not evan entocort, I have such severe side effects, rem cleared up that, but what it did to arthritis and muscle pain was too much to handle, when I was riding that stuff from my body, it came out in my hands, I couldn't evan open gatoraide without using a wrench, it felt like it would tear the skin off my hands, so oh what fun. I start phys. therapy on tues. then on to pain managment clinic, again. I'm to old for this BS. I would like to choke that woman who hit me. and her underinsured friends car.

I had some PT after surgery on a shoulder one time. Got the warm towels , the massage and ultrasound. I was thinking this ain't too bad. Then they started to stretch my arm over my head and it lifted the rest of my body up off of the table like a see saw . I told the guy ,, I'll talk,,,,I'll talk ... Hope they go easy on you....

hey guys, yea sniper, it is beginning to fall into place, but I'm just super depressed, I'm beginning to hate pain med's, just med's in general, if this piece of crap woman would have had decent ins. the law suit would be worth a ton. that's the luck of the irish, I'm not irish, but, thats the luck of a jew, maybe that means, they will settle as soon as I'm ready, 6-9 months, I've got jewish lawyer, so we will give them double whammy, but she hit me at 65mph. I was stopped. I'm just blown away by this. the only good thing, the driver was given 2 citations, 1, for driving to fast under unsafe road conditions, and the other for driving with suspended license. I probably have to go after driver and owner of other car in a civil lawsuit, which means nothing, you can't get blood out of a rock, right now tho, I think I might have to take pred to get this mouth thing flared down.
