I have a strong suspicion I will not be receiving my disability insurance.

I have worked for the same place for 29 years as a support staff to people with physical and developmental disabilities.  I was diagnosised with Fibro about 2 years ago.

about a year and a half ago I reduced my weekly hours of work to 20 hours instead of 40 due to pain and fatigue.  (I had already reduced my work week to 24 hours a week prior to a diagnosis for the same reason).  During July and August this year I worked 2 four hour shifts a week.  I went off totally in Sept.

The insurance company says because I continued to work after being diagnosoed I have proven that I can work some hours weekly and therefore may not be eligible for any payment from them.

I am so upset!!!   Because I tried to "suck it up" and go to work until I just had to admit to myself that I just couldn't do it anymore I may lose my entire disability pension.  This just is not fair!!!

I suppose you could also look at it as if you have it documented that you were having a hard time so obviously you need the disability? I have been on long term disability for nearly 2 years now, so its not unheard of for them to pay out for fibro. I can sympathize with you. It is very anxiety provoking to not know if you will get your disability or not. Its hard to have your future in someone else hands. You will feel much better once you know for sure what is happening.
Get a lawyer if you have to. You are entitled to that money! You worked hard and paid into it for many, many years. Most likely you will have to fight in order to get it though. They dont make it easy!

Working part time can cause a lot of problems. It resets your baseline income and hours worked and can have a negative effect on the benefits you may be entitled too. I sure understand wanting to keep working as much as you can, but it can backfire on us.

Please be aware that this same thing can happen with your social security as it undermines your wage and effective quarters worked. Going from memory ( not a good thing), I think SSA looks at five out of the last 10 yrs you worked. If you work part time and then delay applying for SSDI, it could really reduce your SSDI payments. Maybe you should look at applying for SSDI? Or don't put it off too long.

Sort of a "no good deed shall go unpunished" thing. I'm so sorry this is happening to you. The last thing you need is all the emotional and financial stress this has produced.

Hi megatired, I am sorry they are giving you such a difficult time, dont give up . I am going throuth the same thing just applyed and have not heard back yet but I dont expect them to give it to me without a fight. I was diagnosed with Fibro back in 2005, epilepsy in 2009, and Lupus in 2010 and it has been very difficult for me to work or hold down a job. I get so angry at these people who decide weather of not we should receive it, let them walk in our shoes and see what we have to endure on a daily basis, how if effects every aspect of our life. I will pray for you. and dont give up, I think thats what they expect us to do, just keep re-applying persistance may pay off, good luck to you!

I was in the same situation i was fired from my job when i started missing alot of days and making alot of mistakes. I was diagnoised in 2004 and worked until March 2007. I was out of work a month and i obtained a lawyer and i now have my disablity income as of sept 2009.  It was very hard because it was almost three years before i won, but worth all the effort. I am in NC i know every state is different, but just because you worked those hours and stuck in their, they will not be able to keep you from obtaining what is yours.  If you have good family support finacially and emotinally then you will be okay, but it was a long hard battle that you will breath a sigh of relief if you keep pushing on through.  Best of luck to you !!!
