Back in the late summer I applied for disability due to lupus, porphyria and a host of other problems.  I was immediatly rejected so I got an attorney and she filed the appeal.  Just today I got a letter stating "we have reconsidered this claim and have determined that the medical requirements for disability benefits are met."  Thenit goes on to say "we have not yet made a decision about whether the nonmedical requirements are met." 

What are the nonmedical?  I haven't been able to get hold of my attorney yet and thought someone here would know.

I just started receiving my SSD check, and haven't ever heard that phrase, but just guessing, from what I read in my SSA informational brochures, and my office appt. speaking to an actual and friendly human,  they might be referring to your eligibility in terms of working at a job where you paid into the social security system, for the required number of years.  I know they had to confirm my employment history.

I'm certain those job or work requirements are met. Every year I get a SS statement that says how much of this or that I'm entitled to.
I talked to my attorneys secretary and she thought it might have to do with SSI eligibility. But I know I'm not eligible for that.

I wouldn't worry about it. It sounds like they have approved you but they just add a bunch of jumbo words to complicate and confuse things. I am almost certain you have been approved. Good luck w/ your attorney and don't worry about it too much. I am sure you are good. xxoo

Hi!

I agree you shouldn't worry. And I am glad you didn't give up. I live in NY and I am not eligible for SSI either. My brother has ankylosing spondylitis but didn't work long enough to pay into SS so he is on SSI. He can't have or be given any assets, or even try a limited job on the few days in a month he feels better. On SSD, the rules now support a trial return to work without risking your disabled status, but from what I understand, there is a limit to the amount of money you can earn. I applied in July, saw a SSA MD. in August, my 3 drs. and accupuncturist faxed their forms in quickly, my date of disability was Dec after the required 5 month wait and my check started in Jan. I feel very blessed.

My guess is there is a question of whether you meet the requirements, have enough SS credits, to qualify for SSD.  Below is a link to the page that explains the requirements for eligibility.  If you do not meet these even though you qualify medically you are not eligible.

Thanks for the input everyone, I'm in Indiana Simplistic. I'm certain I've worked enough. As I said before I get the SS form iach year and it tells me how much money I can get if i become disabled, and my lawyer saw that. So I'm sure she wouldn't have taken my case if I was ineligible.
