Can I be fired?

I recently was awarded disability benefits from Social Security, retroactive to Dec 2010, and recently I've had to have my boss find people to cover for me for larger jobs I just can't do anymore.  Since I legally have been declared disabled how difficult is it for them to terminate me?  Or can they?

I believe it differs a great deal from state to state, as well as by what kind of disability you have been awarded and by who. Disability can come thru your work, thru SS, or thru private disability insurance - it can come as partially disabled or fully disabled, temporarily disabled or permanently, and so forth.

The best way to get the correct answer for you is probably to find a legal aid (free attorney!) office in your area and chat with them about all the particulars.

If your company offers the FMLA than I would recommend getting your doctor to fill it out! I have gotten one for the last 3 years since I have been in and out of the hospital and it makes it nearly impossible to be fired for medical reasons!

I agree with Amy, you should get an FMLA approval. Then the company can't do anything to you. I too, have had one one file with my company.

I'm not sure exactly what that is. I know my Dr. has mentioned that to me but I don't understand what it is. I'm able to work a few hours at a time, it's just the longer 4-8 hours shifts I can't do anymore. I should mention, I'm a merchandiser which means I go out and service different stores for different manufacturers but I am a W2 employee and not an independent contractor for this particular company.

FMLA covers your time when you cannot work. I work for a telecon company and as long as I have a cert on file from FMLA. The company can't fire me as long as I stay within my certifcation. The FMLA tells you, your company how many hours/days that you will be able to take off. My last one told them that I can be off up to 3 days per week. The superviser hated it. He tried everything to fire me. It was so bad with him, that I had to go to the EEO. Guess who isn't with the phone campany anymore. If, your company has FMLA.....Please get the paperwork...Your life/health may depend on it.
