I WON!!!! The judge told us he was approving my case with a review to be done in 3 years. It was so much easier than I was expecting. Heck it was easier than my divorce. Now to await the official letter and the direct depositing of my first back payment amount.

That's wonderful!!! Can I ask what state you are in and how long it was between filing for a hearing and getting one?

MI I filed first in March 2005 denied in late June asked for a hearing in early July (still 2005) and I only got my hearing now because I will be homeless in less than 2 full months otherwise it would be november or later.

Hey redrose, wow that's wonderful! That has to be such a releif to you. Now get them on the ball with your check. I hope they go back to when you first applied. If they did .........Can I move in with you? LOL Just kidding

Now I have to get proof of my husband's monthly income taxable by Social Security from March 2005 to the present within the next week or two. That could prove difficult. I will make him ask for it tomorrow giving him a specific list of what I need printed on the letter head. Nice of the judge to decide to tell me today though hopefully the official letter comes fast cause I will be providing my lawyer with the proof of income as well as my local office so I know that it gets where it needs to be. I will also keep a copy.

So happy for you Redrose, prayers answered and good timing for you. Why are they reviewing again in three years? Is that normal? I don't remember them telling me that. Maybe becaue your're in school I'm so happy for you. YEAH!!!!!!!!!!

Legally they are supposed to review you in three years now. Then if you don't appear to be doing better they can do it less often but no less often than 5 unless it becomes something that you will die from.

Congratalations,

Can you tell us what happened when you walked in the court room?  What did the judge ask?, Did you have to explain you illness to the judge?.  Yesterday, I asked for a hearing re: my ssd case. I applied in Aug 06'.  Would appreciate your help. I will be very nervous when my time comes too.

Sunshinesl, My lawyer asked a whole bunch of questions about my disease and treatment. The judge asked about my education and work history and my mental health. He also asked about my children- custody issues mostly but also if my current husband and I have children (we did one who died). He was very matter of fact about everything. He asked about medications and side effects. Then without ever talking to the vocational expert he said, Okay so you have x,y,z, and a, b, c too. We will pay it and review the case in three years. Sorry I can't recall which of my conditions he focused on. My lawyer was really big on getting me to describe pain and fatigue levels. Both on scales of 1-10 and also with pain what it actually FEELS like. My lawyer asked me if I was given the job of the security guard without having to throw anyone out- being able to get up and sit down when I wanted how many hours could I work I said 2-3. He asked why- I told the truth I would have to lay down. It is better to have a lawyer but be sure you have all the good medical evidence and doctors who will back you up before you hire one. Then hire one. I would have lost and waited until November for a hearing had I opted to forgo the lawyer.

Great.  It must be a big relief to have it approved.  It took me 3 tries and although it is not a lot of money it provides stability for us and takes away all the financial pressure. 

Hope your ex provides the necessary financial info quickly.

Bill, how long after your hearing did you get the official letter? I was told at the end of my hearing so I have a jump on getting all the info (btw it is my current hubby not ex who needs to get me income info but his work can be as bad as dealing with the ex).

Actually, I never had a hearing.  The alj reviewed my application and approved it without reservation.  I got the official notice about 2 1/2 weeks after filing.  Unusual and possibly my lawyer had something to do with it but he would never explain.  The only thing he did say was that judges have "quotas" and they often took obvious cases and just approved them.  Mine was one of those.

Sorry about the slip.  Blame it on prednisone.

By law, SSD will give you the money within 60 days.  If my bank had not screwed up the transaction I would have had it in about 6 weeks.

Bill, thanks. I think I am going to make a call today and see if my case file is at the writing stage yet and if so how long the writing stage takes a rough estimate. I will also be gathering what I need to get a hardship check issued and calling my senator so they can help me speed the process of getting my funds because July 31 I have no home. Heck I can't afford rent so it could happen a lot sooner. Rent is more than hubby makes in a single month after taxes and health insurance. Yeah my case was one of those where the medical evidence was overwhelming and my original judge retired and the new one picked me. He listened to the lawyers questions and my answers asked a few small questions then said it would be paid- meaning I won. My lawyer said my judge is one known for NEVER telling the decision at the hearing so I have to assume he had already decided long before I got in there and the hearing was a formality necessitated to justify giving it to me because of my age and education as well as IQ. Someone at the original level dug into my school records and found the IQ results from 2nd grade and used that as part of my denial originally. The judge already had a list of all that was wrong with me and even my meds. He had only a few areas in my record marked and only 1 area was against me and it was from way back in 2002. Heck he never even asked the vocational expert a single question or let him say anything. So now I wait and hope things go quickly.
