Filing A Federal Tort Claim

I'm on the DOJ website & there are a couple of things that i wasn't aware of in my previous post.
1. A claim under the FTCA must be filed within 2 years after the 'claim accrues.' Normally, that means 2 years after the doc saw you; but, since we've all been mis-dx'd numerous times... the clock doesn't start ticking until we become aware of the real issue. Until we get the actual dx of LD/B.b. For those in the early stages, it is advisable to keep all records, request lab work, dr's reports, etc. Anything & everything may be of value whether you file a malpractice suit; or sue the CDC. In both cases, you may be awarded $$$.

2. You sue the CDC by requesting a Standard Form 95; then fill out the blocks. You must fill in a dollar amount in block 12d or they will not process your claim.

My personal feeling is: unless we have at least 100 people who are willing to file a Federal Tort, it's probably pointless to go that route. Anyone can contact a private attorney to sue a dr/hospital; but the only way we really get the CDC's attention is by sheer numbers. This is a legitimate process; but it's also a tactic/strategy. If enough of us "Lymies" file, I believe they would be willing to negotiate (revise their criteria) rather than have to defend a few thousand lawsuits. As a veteran, I know the DOJ is already over-burdened. There are close to a million VA claims back-logged in the system right now. Mine is one of them. I read Court decisions weekly & the gov't always asks for additional time to prepare their brief, etc. Their lawyers would have to defend CDC as well.

I'm not an attorney. Some days I'm doing good to just tie my shoes. Even so, I have a few "lucid" moments & this BS with IDSA docs and the CDC has gone on far too long. Since we're the only ones actually suffering, we have to get the ball rolling. Too many others have no idea what's going on, or that they're infected with B.b. We have to reach out to them also. I certainly welcome any & all suggestions or comments. Again, our strength/wisdom is in numbers.

I wouldn't want you to jeopardize your SSI because the gov't can be vindictive. It's a legitimate concern. I'm on SSD but have been so long they won't/can't kick me off. (?) I'm going to post more on this in a bit. Hopefully, there are enough 'Lymies' who have 'had enuff' to make a difference. Glad you got SSI; you may be elgible for SSD which would mean more money. Whether SSI/SSD don't let them pull the rug out from under you. By all means: appeal... appeal...appeal any adverse ruling.
