Steve, it all boils down to cost. I am not inclined to bring suit against AMS even if there were 20 attorneys in line waiting to take the case. What I was searching for was any product recalls for any of the AMS implants in order to mitigate my out of pocket expenses. I am already having problems with my health carrier as I am appealing to them for an out of network surgeon and hospital to be covered as in network. This revision is affordable if covered by in network coverage $12-1,500.00 + vs. $15-20,000.00 +.All I want is a properly working and efficient implant. I was by profession a claims adjuster and supervisor. For us that need implants it makes no sense to have attorneys sue and put them out of business, unless there is provable gross negligence on the parts of all concerned, surgeon, hospital and the maker of the implant or it be singular.We are also looking at two different areas of law, Tort and Warranty. The big money is in tort law not warranty, however, warranty can be lucrative under the right factual circumstances.
